SMS and Messaging Terms

How text messaging works at Cobblestone POS — our own program, and the rules for restaurants that message their customers through the Platform.

Last updated: October 20, 2026

Two separate programs

This page covers two different kinds of text message, because they have different senders and different rules.

  1. Cobblestone POS Alerts — messages Cobblestone POS LLC sends to a business or prospective business about its own account, demo or onboarding. We are the sender. Sections 2 to 9 below describe this program.
  2. Messages a restaurant sends to its customers through the Platform — order updates, loyalty rewards and promotions. The restaurant is the sender, not us. Section 10 sets out the rules a restaurant agrees to follow.

Program description

Program name:
Cobblestone POS Alerts
Sender:
Cobblestone POS LLC

If you opt in, you consent to receive recurring automated text messages from us at the mobile number you provide. Messages may include:

  • A reply to a demo request, and scheduling for a demo or an onboarding call.
  • Setup and onboarding steps while your account is being configured.
  • Account, billing and security notices.
  • Service alerts — for example, a payment gateway or hardware issue affecting your register.
  • Occasional product news and offers, where you opted in to marketing messages.

How you opt in

You can give consent in any of these ways:

  • By checking the SMS consent box on a form on this website and submitting your mobile number.
  • By texting us first at a number we publish, or replying to a message from us.
  • By giving us your mobile number verbally or in writing during a demo, onboarding call or support conversation, and agreeing to be texted. We keep a record of that consent.
Consent to receive marketing text messages is not a condition of any purchase and not a condition of using Cobblestone POS. You can use the Platform without ever opting in, and you can opt out later without losing any feature.

Message frequency

Message frequency varies. Expect up to 8 messages per month, depending on where you are in setup, whether you have an open support issue, and whether you opted in to marketing. Transactional messages — a security notice, or a reply you asked for — are sent as needed.

Message and data rates

Standard message and data rates may apply to each message sent or received, according to your plan with your wireless carrier. Cobblestone POS does not charge you for text messages. Contact your carrier for details about your own plan.

How to stop messages

Reply STOP to any message to opt out. You will get one final confirmation message, and then no further messages, unless you opt in again.

You can also reply END, QUIT, CANCEL, UNSUBSCRIBE or OPTOUT, or email us and ask to be removed.

Opting out of marketing messages does not stop essential account and security notices, which we may still send by email.

How to get help

Reply HELP to any message for help and our contact details, or email hello@cobblestonepos.com.

Carriers and delivery

Message delivery depends on your carrier and your device, and we cannot guarantee that a message will arrive or arrive on time. Wireless carriers are not liable for delayed or undelivered messages. Supported carriers may change. Messages may not be deliverable to every carrier or to some prepaid plans.

Privacy

We use your mobile number to send the messages described above, and to reach you about your account. It is sent to our messaging provider, Twilio, in order to deliver the message.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Our full Privacy Policy explains what else we collect and how long we keep it. For privacy requests, email hello@cobblestonepos.com.

Rules for restaurants messaging their customers

If you run a restaurant on Cobblestone POS and use the Platform to text your customers, you are the sender of those messages and the law treats you as responsible for them. By using messaging features you agree to the following.

  • You will obtain express consent from each customer before sending them a message, and express written consent before sending them a marketing message, as the Telephone Consumer Protection Act and carrier rules require.
  • You will keep a record of each consent — what the person agreed to, when, and where it was captured — and provide it if a complaint is made. The Platform records consent for opt-ins captured through it; consent you collect elsewhere is yours to document.
  • You will never upload, import or message a purchased, rented, scraped or shared list of phone numbers.
  • You will identify your business by name in your messages, and tell recipients how to stop.
  • You will honor every opt-out immediately and will not message a number again after a STOP request unless the person opts back in.
  • You will keep message content consistent with the use case registered for your campaign, and will not send anything carriers prohibit.
  • You will not send messages for someone else, or let another business send through your account.

Consent cannot be bought, inherited or assumed. If you acquire a business, its customers' consent does not automatically transfer to you — and consent collected by the previous owner of a location is not yours to rely on.

We may suspend messaging on your account immediately, without notice, if we receive a carrier notice, a spam-rate warning, or a credible complaint that you messaged someone without consent. Messaging stays off until the problem is resolved. A violation can also get a phone number permanently blocked by carriers, which we cannot reverse.

We register messaging campaigns with carriers for some merchants. Doing so does not transfer your consent obligation to us. You indemnify us for claims arising from your messaging, as set out in the Terms of Service.

You also need your own privacy policy and your own SMS disclosures on your own website, naming your business as the sender. Carrier reviewers check for them.

Changes

We may update these terms. The "Last updated" date above shows when they last changed, and we will give notice of a material change.
